These terms govern your use of eirenrowe.com and any purchase you make from us. By using this website or placing an order you agree to them. Please read them before you order.

1. Who we are

This website is operated by Eiren Rowe. Throughout these terms, "we", "us" and "our" refer to Eiren Rowe, and "you" refers to the person using the site or placing an order. Our contact details are at the end of this page.

2. Eligibility

You must be at least 18 years old, or have the consent of a parent or guardian, to place an order with us.

3. Products and descriptions

We try to describe and photograph every product as accurately as we can. Colours can vary between screens and devices, and measurements may differ slightly between garments of the same size. Minor variation of this kind is not a fault. If an item is materially different from its description, it is covered by our Refund Policy.

All products are subject to availability. If an item you have ordered is unavailable we will contact you and refund you in full.

4. Pricing

Prices are shown in the currency displayed at checkout and include all taxes we are required to collect. We may change prices at any time, but changes will not affect an order you have already placed and paid for.

If a product is listed at an incorrect price due to an error, we are not obliged to supply it at that price. We will contact you before dispatch to offer you the item at the correct price or to cancel and refund the order in full.

5. Orders and acceptance

Placing an order is an offer to buy. Our confirmation email acknowledges your order but does not accept it. A contract is formed when we dispatch your goods. We may decline or cancel an order — for example where the item is out of stock, the price was wrong, the payment cannot be verified, or we reasonably suspect fraud. If we cancel, we refund you in full.

6. Payment

Payment is taken in full at checkout. We accept the payment methods shown at checkout. All payments are processed through Shopify's secure payment system; we do not store your full card details.

7. Shipping and risk

Shipping is covered by our Shipping Policy, which forms part of these terms. Risk in the goods passes to you on delivery.

8. Returns

Returns and refunds are covered by our Refund Policy, which forms part of these terms.

9. Your account

If you create an account, you are responsible for keeping your password secure and for activity that occurs under your account. Tell us promptly if you believe your account has been used without your permission.

10. Acceptable use

You agree not to use this site for any unlawful purpose, to attempt to gain unauthorised access to it, to interfere with its operation, or to copy, scrape or republish its content for commercial purposes without our written permission.

11. Intellectual property

All content on this site, including text, photographs, graphics and layout, is owned by us or used under licence and is protected by copyright and trade mark law. You may view and print pages for your own personal use only.

12. Third-party links

This site may link to websites we do not control. We are not responsible for their content, products or privacy practices.

13. Liability

To the extent permitted by law, we are not liable for indirect or consequential loss arising from your use of this site or from any product, and our total liability to you is limited to the amount you paid for the relevant order.

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where we are permitted to limit our liability for a breach of a consumer guarantee, our liability is limited to replacing the goods, supplying equivalent goods, or refunding the price you paid.

15. Changes to these terms

We may update these terms from time to time. The version published on this page at the time you place an order is the version that applies to that order.

16. Governing law

These terms are governed by the laws of the State of Texas, United States. If you are a consumer in Australia, this does not deprive you of the protection of the Australian Consumer Law or of your right to bring proceedings in the courts of your place of residence.
